For the record, if the theory of gravity fails to predict the behavior of matter in spacetime - in every situation - it is wrong. Period. Doesn't matter if the situation in which the failure occurs is extremely rare; if the theory can't explain what happens in every situation, it's wrong.

If hermaphrodites exist, then biological sex isn't binary. It doesn't matter if only one person in all of human history has been a hermaphrodite. if it's possible for a person to have the genitalia of a male and a female, then sex isn't binary.
